1. Introduction & Acceptance

Welcome to TicketRacer (https://ticket-racer.com/), operated by S.C. RETEHCOM S.R.L ("we", "us", "our"). These Terms of Service ("Terms") govern your use of our website, services, and content (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

We reserve the right to modify these Terms at any time. Material changes will be communicated via a prominent notice on our website and by updating the "Last Updated" date at the top of this document. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

2. Description of the Service

TicketRacer is a price comparison and aggregation platform for motorsport event tickets. Specifically, the Service:

• Aggregates ticket pricing, availability, and ticket features from third-party ticket reseller websites ("Resellers").
• Utilises automated systems to classify, standardise, and categorise tickets from various sources into a unified display format.
• Displays this information, alongside third-party review scores (such as Trustpilot and Google Reviews), to help users compare ticket options.
• Provides outbound links to Reseller websites where users can purchase tickets directly.

3. Disclaimers: Accuracy of Data, Pricing, & Automated Processing

3.1 Automated Processing & Accuracy

To provide a unified comparison experience, TicketRacer uses automated systems to extract, parse, and synthesise ticket details (e.g., ticket features, day types, grandstand categorisations) from Reseller websites.

While we strive for accuracy, we do not guarantee that our automated classification is error-free. Our systems may occasionally misinterpret or incorrectly label ticket features (e.g., whether a ticket includes "Hospitality" or is "General Admission").

You are solely responsible for thoroughly reading and verifying all ticket details, features, and inclusions on the Reseller's official checkout page before completing any purchase.

3.2 Pricing & Availability

Pricing and availability data is sourced dynamically from Resellers and is refreshed daily. Because prices fluctuate, the price displayed on TicketRacer may differ from the price shown on the Reseller's website at checkout. Factors such as currency conversion, Reseller fees, processing costs, and taxes may apply.

TicketRacer never adds a fee of its own. We do not charge you anything for using the Service. Any booking charges, delivery costs, payment surcharges, or taxes that apply are set and collected by the Reseller, not by us. Where we earn a commission, it is paid by the Reseller out of their own margin and does not increase the price you pay (see section 4). Always check the Reseller's final checkout total before you buy.

3.3 How We Rank Tickets

We rank tickets by price, cheapest first. Some outbound links carry affiliate codes that earn us a commission if you complete a purchase, at no extra cost to you. Commission never affects the order in which tickets are shown, and no Reseller can pay for a higher position.

3.4 Third-Party Reviews & Ratings

TicketRacer may display aggregated review scores or ratings for Resellers (e.g., Trustpilot or Google Reviews). These scores are provided by external platforms and exist for informational purposes only. We do not independently verify these scores and do not endorse any Reseller, regardless of their rating.

4. Affiliate Relationships & Commercial Disclosure

Some outbound links on TicketRacer may contain affiliate tracking codes. When you click such a link and complete a purchase on the Reseller's website, we may receive a commission from the Reseller based on the transaction value.

Key disclosures:

• Affiliate relationships do not influence our automated standardisation of tickets, nor do they inherently alter the ranking, ordering, or presentation of ticket prices unless explicitly labelled as "Sponsored" or "Featured/Promoted."
• The commission is paid by the Reseller and does not increase the price you pay for the tickets.
• We are committed to transparency and will clearly mark any explicitly paid placements.

5. User Responsibilities & Prohibited Conduct

By using the Service, you agree not to:

1. Use the Service for any unlawful, fraudulent, or malicious purpose.
2. Scrape, harvest, or collect data from the Service using automated means (e.g., bots, spiders, or crawlers) without our express written permission.
3. Access or attempt to access our underlying systems or databases without authorisation.
4. Interfere with the proper functioning of the Service, including attempting to circumvent rate limits or execute denial-of-service attacks.
5. Reverse-engineer, decompile, or disassemble any part of the Service software.

6. Intellectual Property

6.1 Our Content

All content, underlying code, custom datasets, and graphical representations on TicketRacer are the property of S.C. RETEHCOM S.R.L or its licensors and are protected by applicable intellectual property laws. You may not reproduce or extract this content without our prior written consent.

6.2 Third-Party Trademarks

Motorsport event names (e.g., Formula 1®, MotoGP™), circuit names, team names, Reseller brands, and associated logos are the trademarks of their respective owners. F1, FORMULA ONE, FORMULA 1, FIA FORMULA ONE WORLD CHAMPIONSHIP, GRAND PRIX and related marks are trade marks of Formula One Licensing B.V. TicketRacer is an independent comparison platform and is not affiliated with, sponsored by, or endorsed by the Formula 1 companies, Dorna Sports, any circuit operator, or any event organiser unless explicitly stated.

7. Third-Party Websites & Services

The Service contains links to third-party Reseller websites.

• We have no control over the content, terms of service, privacy policies, or checkout practices of third-party websites.
• We are not responsible for the security of third-party websites or their handling of your personal or payment data.
• Users access third-party websites at their own risk and must comply with the ticketing policies of the respective Reseller.
• We are not a party to any transaction between you and a Reseller. Any disputes regarding a purchase, validity of tickets, refunds, or cancellations must be resolved exclusively with the Reseller.

8. Data Sourcing, Web Scraping, & API Integrations

TicketRacer automatically aggregates pricing and ticket inventory data from third-party Reseller platforms (e.g., via APIs or careful web scraping practices). We endeavour to:

• Only access publicly available ticketing data.
• Respect the technical boundaries and server health of the platforms we index.
• Provide clear referral traffic back to the source platforms.

If you represent a Reseller platform and have concerns regarding how your data is indexed, please contact us at info@ticket-racer.com to discuss API integration, affiliate partnerships, or data-sharing agreements.

9. Privacy, Cookies, & Analytics

Your use of the Service is also governed by our Privacy Notice, which sets out what we collect and lists every cookie we set.

To improve our Service, monitor performance (via Sentry), and understand user behaviour, we use third-party analytics and tag management solutions, such as Google Tag Manager and Google Analytics. By interacting with the Service, you consent to our use of cookies and tracking technologies as managed through our Cookie Consent preferences manager and as detailed in our Privacy Notice. You can change or withdraw that consent at any time through the Cookie settings link in the footer of any page.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

1. We are not liable for any loss or damage arising from your use of or reliance on the Service, including but not limited to:
   • Inaccurate pricing, automated classification errors, or outdated availability data.
   • Failed transactions, fraudulent resellers, or non-delivered tickets.
   • Event cancellations, schedule changes, or circuit modifications.
   • Reliance on third-party review scores displayed on our platform.
2. We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or travel expenses.
3. Our total aggregate liability to you for any claims arising under these Terms shall not exceed 100 euros.
4. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.

11. Indemnification

You agree to indemnify, defend, and hold harmless S.C. RETEHCOM S.R.L, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or any dispute you have with a Reseller.

12. Governing Law & Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of Romania.
• Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Reghin, Jud. Mureș.
• Before initiating formal proceedings, you agree to attempt to resolve any dispute informally by contacting us at info@ticket-racer.com.

EU Consumer Rights

If you are a consumer residing in the European Union, you retain any mandatory consumer protection rights granted by the law of your home country. You may also access the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

13. Miscellaneous

1. Severability: If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
2. Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right.
3. Entire Agreement: These Terms and our Privacy Notice constitute the entire agreement between you and TicketRacer.
4. Force Majeure: We are not liable for delays or failures caused by circumstances beyond our reasonable control (e.g., natural disasters, widespread internet outages).
